Terms of Service
Scope of Application
- These terms and conditions apply to contracts for the rental provision of hostel rooms and beds for accommodation, as well as all other services and deliveries provided to the customer by Townside Hostel.
- The subletting or further renting of the provided rooms, as well as their use for purposes other than accommodation, require the prior written consent of Townside Hostel.
- Customer terms and conditions shall only apply if agreed upon in advance.
Contractual Liability, Statute of Limitations
- The contract is concluded upon acceptance of the customer’s request by Townside Hostel. Townside Hostel is free to confirm room bookings in writing.
- The contracting parties are Townside Hostel and the customer. If a third party has made a booking on behalf of the customer, they shall be jointly and severally liable with the customer for all obligations arising from the accommodation contract, provided that Townside Hostel has received a corresponding declaration from the third party.
- Townside Hostel is liable for its contractual obligations. In non-performance-related areas, liability is limited to intent and gross negligence.
- The limitation period for all customer claims is six months.
- This limitation of liability and short limitation period also apply to pre-contractual obligations and positive contract violations in favor of Townside Hostel.
Prices, Payment, Set-Off
- Townside Hostel is obligated to provide the rooms/beds booked by the customer and to render the agreed services.
- The customer is obligated to pay the applicable or agreed prices of Townside Hostel for the room rental and other services utilized no later than upon arrival. This also applies to services and expenses incurred by Townside Hostel on behalf of the customer.
- The agreed prices include the statutory value-added tax.
- Applicable prices may be changed by Townside Hostel if the customer requests subsequent changes to the number of booked rooms, hostel services, or length of stay, and Townside Hostel agrees.
- Invoices from Townside Hostel without a due date must be paid within five days of receipt without deduction. Townside Hostel is entitled to declare outstanding amounts due at any time and demand immediate payment. In the event of payment default, Townside Hostel is entitled to charge interest at 5 percentage points above the base interest rate. The customer has the right to prove that no or a lower damage has occurred, while Townside Hostel may prove higher damages.
- Townside Hostel is entitled to request an appropriate advance payment or security deposit upon contract conclusion or thereafter, considering the legal provisions for package travel. The amount of the advance payment and payment deadlines can be agreed upon in writing in the contract.
- The customer may only offset or reduce claims against Townside Hostel with undisputed or legally established claims.
Customer Withdrawal (Cancellation)
- For bookings that are made without an offer created by Townside Hostel, a cancellation period of four days applies. The arrival date is counted from 00:01 AM. Cancellations must be made in writing or via email and require written confirmation from Townside Hostel. Special cancellation deadlines apply to group bookings (from 10 persons), which can be found in the offer or confirmation.
- Customer withdrawal from the contract with Townside Hostel requires written approval from Townside Hostel. If no such approval is granted, the agreed price must still be paid even if the customer does not use the services. This does not apply in cases of delayed performance by the hostel or impossibility of service provision attributable to it.
- If a withdrawal deadline has been agreed upon in writing between Townside Hostel and the customer, the customer may withdraw from the contract within this period without incurring payment or damage compensation claims from Townside Hostel. A processing fee of €7.50 will be deducted from any refund of advance payments. The customer’s right of withdrawal expires if they do not exercise this right in writing by the agreed deadline, unless there is a delay in performance by Townside Hostel or an impossibility of performance attributable to it.
- Townside Hostel is free to claim a lump-sum compensation for damages incurred due to the customer’s withdrawal. In this case, the customer is obligated to pay the contractual overnight costs for the first night. The customer is free to prove that no damage occurred or that the damage incurred was lower than the demanded lump sum.
Townside Hostel Withdrawal
- If a withdrawal right of the customer has been agreed upon in writing within a certain period, Townside Hostel is entitled to withdraw from the contract within this period if other customer requests exist for the booked rooms and the customer does not waive their right of withdrawal upon request.
- If an agreed advance payment is not made even after an appropriate grace period set by Townside Hostel has expired, Townside Hostel is entitled to withdraw from the contract.
- Additionally, Townside Hostel may withdraw from the contract for objectively justified reasons, such as force majeure or other circumstances beyond Townside Hostel’s control preventing fulfillment of the contract, bookings made under misleading or false information regarding essential facts (e.g., the person or purpose), or if there are reasonable grounds to believe that the customer’s use of hostel services could jeopardize the smooth operation, safety, or public reputation of Townside Hostel without being attributable to its control or organizational sphere.
- Townside Hostel must promptly inform the customer of the exercise of its right of withdrawal.
- In the event of a justified withdrawal by Townside Hostel, the customer has no claim for damages.
Provision, Handover, and Return of Rooms/Beds
- The customer has no entitlement to the provision of specific rooms/beds. Booked rooms/beds are available to the customer from 3:00 PM on the agreed arrival date.
- There is no entitlement to earlier provision. On the agreed departure date, rooms/beds must be vacated by 10:00 AM.
- If not vacated on time, Townside Hostel may charge 100% of the full lodging price (list price) for additional use. The customer is free to prove that no damage or significantly lower damage occurred.
Liability of Townside Hostel
- Townside Hostel is liable for the diligence of a prudent merchant. However, this liability is limited to intent and gross negligence for non-performance-related areas.
- Customers acknowledge that multi-bed rooms are rented, and guests share a key, meaning others may access the room. Townside Hostel offers storage for valuables and provides sufficient lockers in dormitories. Liability for stored valuables is limited to one hundred times the room/bed price, up to €1,500, and up to €750 for money and valuables. No liability is assumed for loss or theft from lockers, luggage storage, or cloakrooms. Liability claims expire if the customer does not promptly notify Townside Hostel (§ 703 BGB).
- If a parking space is provided on the hostel premises, whether for a fee or not, this does not constitute a safekeeping contract. Townside Hostel is not liable for theft or damage to vehicles or contents unless due to intent or gross negligence.
Miscellaneous Provisions
- Persons under 18 are not permitted to stay in dormitories. Minors may only stay in private rooms if accompanied by at least one adult, except for groups accompanied by an authorized adult.
- A maximum stay of 14 nights per month applies for dormitory stays.
Final Provisions
- Changes or additions to the contract, acceptance of applications, or these terms should be made in writing. Unilateral changes by the customer are ineffective.
- Place of fulfillment and payment is the location of Townside Hostel Bremen.
- The exclusive place of jurisdiction is the location of Townside Hostel. German law applies.
- Should individual provisions of these terms be ineffective or void, the validity of the remaining provisions remains unaffected.
